Russia: Court of cassation refers HIV-related migration case back to lower court

The Court of Cassation has referred the case concerning the undesirability of a migrant with HIV remaining in the country back to Tula
The First Court of Cassation of General Jurisdiction considered the case concerning a complaint lodged by Uktam T., a citizen of Uzbekistan, against the refusal of the Tula Region Office of Rospotrebnadzor to review the decision declaring his presence in Russia undesirable, which had been taken on the grounds of his HIV infection.
As established by the courts, the Directorate had adopted the decision declaring his presence undesirable back in October 2023 — on the basis of a medical report stating that the foreign national suffered from a disease posing a danger to others. In the summer of 2025, the foreign national married a Russian citizen and subsequently applied to Rospotrebnadzor to have the decision overturned. According to a report from the AIDS centre, the man has been receiving antiretroviral therapy regularly since autumn 2024; the disease is in remission and viral load is suppressed.
T. appealed to the court, insisting that his marriage provided grounds for a review of the decision. The migrant lost his case in two lower courts and then appealed to the Court of Cassation. The Court of Cassation noted that the judges in Tula had failed to establish the circumstances surrounding Rospotrebnadzor’s consideration of the application in August 2025, the foreign national’s compliance with legislation on the prevention of the spread of HIV infection, his financial means to pay for antiretroviral drugs, his viral load monitoring, and his receipt of psychosocial counselling.
Furthermore, the courts had ruled on claims that had not been raised, and the court of first instance had not invited the claimant to clarify his claims, even though the intended outcome was evident from the claim – a review of the decision in light of new circumstances.
The judicial panel quashed the decision of the Central District Court and the appeal ruling of the regional court. The case will be reheard at first instance.
