Historic regulations in Denmark
In 2007, the foreign ministers of Norway, Sweden, and Denmark addressed their American colleague Condoleezza Rice with an open letter requesting reconsideration of the regulations directed against people living with HIV wishing to enter the US. This is the first time that this dispute was taken to the state level.
Treatment access in Denmark
The following summarises available information on access to healthcare for people living with HIV in Denmark. There is no evidence that non-nationals are restricted from accessing treatment in the same way as nationals.
Official information states that a person who resides in Denmark has the right to free hospital treatment. A person who is staying in Denmark temporarily, i.e. without having a place of residence in Denmark, can receive acute and continued hospital treatment, but payment is generally charged for these services unless the person has approved documentation for the right to free hospital treatment. The region can provide acute and continued hospital treatment free of charge when, exceptionally, under the circumstances, the region considers it reasonable.
A list of hospitals and other HIV services are available from the HIV Denmark website.
The HIV Justice Network's Global HIV Criminalisation Database
There is no known HIV criminalisation in Denmark. We are not aware of any HIV-specific criminal laws in force, and although there have been historic prosecutions for alleged HIV ‘exposure’, non-disclosure, and/or transmission under general criminal laws, the use of these laws in HIV cases is now suspended.
Visit the Denmark page on the Global HIV Criminalisation Database to see more information about known HIV criminalisation laws in this country, an overview of how the laws are used, and any significant advocacy developments.
UNAIDS Global AIDS monitoring data
This information about access to HIV services comes from UNAIDS https://lawsandpolicies.unaids.org/, a platform to view data on HIV-related laws and policies. This is information provided by national authorities and civil society and may contradict other sources.
